Bidbro Auctions Terms and Conditions of Service

1. Welcome to Bidbro Auctions

By accessing or using our platform, you agree to the following terms and conditions. Please read them carefully as they affect your legal rights and obligations.

2. Acceptance of Terms

By using the Bidbro Auctions ('Bidbro'), you agree to be bound by these Terms of Service and any additional terms that may apply to specific sections or services on the site, or to products and services available through the site.

3. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts under the law of the Federal Republic of Nigeria to participate in auctions. By registering, you confirm that all information you provide is accurate and up-to-date.

4. Bidding Rules

4.1. Bidding Process

  • - Once you place a bid, you are entering into a legally binding agreement to purchase the asset if you are the highest bidder at the close of the auction. Bids cannot be retracted once placed.
  • - All items are auctioned on an 'As-Is' basis. Buyers are advised to inspect items carefully and review auctioneer descriptions. Bidbro is not responsible for discrepancies between descriptions and their actual condition.

4.2. Dynamic Starting Price

  • - For the first bid: The starting price includes the reserve price, a bid premium, and VAT (where applicable).
  • - For subsequent bids: The starting price will be the highest previous bid plus the bid premium and VAT (where applicable). This dynamic price structure ensures that all bidders are aware of the total payable amount from the outset.

5. Account Security

You are responsible for maintaining the confidentiality of your account credentials and are liable for all activities conducted through your account. In the event of any security breach or unauthorized access to your account, you must notify Bidbro immediately.

6. Referral Program

6.1. Benefits

  • Bidbro offers a referral program where both auctioneers and bidders can benefit:
  • - 15% on seller commission paid by the referred auctioneer after a successful sale.
  • - 5% on the bid premium paid by a referred bidder after a successful win.
  • Referral bonuses are one-time rewards and will be credited to your referral wallet following verification

7. Payment & Asset Collection

7.1. Payment Terms

  • - Bidders without a verified National Identification Number (NIN) can only bid on assets below ₦100,000.
  • - You must fund your wallet with an amount above the starting bid amount shown. Bid amounts are all-inclusive (bid price + bid premium + VAT).
  • - Once your wallet is funded, you can place bids. Funds will be locked during the bidding process and unlocked if your bid is unsuccessful.
  • - You can fund your wallet using a credit/debit card or bank transfer. All successful payment service fees, including Paystack or bank transfer levies but excluding bid premium and taxes, are non-refundable.

7.2. Asset Pickup & Release Code

  • - Upon successful payment, the bidder will receive an asset release code.
  • - You are required to inspect the asset before providing the release code. Any discrepancy must be reported to Bidbro before releasing the code.

7.3. Penalties for Failed Pickup

  • - Winning bidders must pick up their assets within three (3) days of receiving the asset release code. Failure to do so will incur a 5% penalty on the winning bid price. If the pickup is delayed, the next highest bidder may assume the asset, and the original winner may be restricted from future auctions.

7.4. Wallet Usage

  • - Funds deposited into your Bidbro wallet are strictly for use within the platform to participate in auctions by placing bids.
  • - Should you wish to use the funds for any other purpose or outside transactions, you must initiate a withdrawal to transfer the funds back to your preferred payment method.

8. Return Policy

Some items may be eligible for a 7-day return policy, as indicated by a return policy tag on the auction listing. Bidders must notify Bidbro within 7 days of receiving the item if they wish to return it, subject to our return procedure.

9. Prohibited Items

Bidbro strictly prohibits the sale of stolen, counterfeit, or illegally sourced goods. Auctioneers selling such items will face immediate suspension and be reported to the relevant authorities. Auctioneers are responsible for ensuring that all items listed comply with Nigerian laws.

10. Illicit Funds and Indemnification

  • - The use of illicit proceeds to fund wallets is strictly prohibited.
  • - In the event that the legitimacy of funds is questioned by law, Bidbro and auctioneers are indemnified from any claims or legal liabilities arising from such use.
  • - Users are solely responsible for ensuring that all funds used on the platform comply with applicable laws.

11. Discrepancy Resolution

If an asset does not match its description, bidders may raise a query during pickup. Bidbro will investigate within 48 hours and determine appropriate actions, which may include refunds or penalties. Auctioneers found responsible for fraudulent listings will face account suspension.

12. Intellectual Property

All content on Bidbro’s platform, including text, software, images, and design, is protected by intellectual property laws. You are prohibited from copying, reproducing, modifying, or distributing any content for commercial purposes without prior written permission from Bidbro. Unauthorized use will result in suspension and possible legal action.

13. Use of Automation

The use of bots, spiders, or any automated devices to participate in auctions is strictly prohibited. Any violations will result in immediate account termination and possible legal action.

14. Withdrawal Limits

Accounts without a verified National Identification Number (NIN) have a lifetime withdrawal limit of ₦100,000. Withdrawal limits for verified accounts are subject to the policies set by Payment Service Providers in compliance with Nigerian financial regulations.

15. Changes to Terms of Service

Bidbro reserves the right to modify or change these Terms of Service at any time. Users will be notified 30 days in advance of changes taking effect. Continued use of the platform after the notice period will be considered acceptance of the new terms.

16. Arbitration and Dispute Resolution

All disputes must first be resolved internally. If a resolution cannot be reached, the dispute will be referred to arbitration before proceeding to court. Arbitration will take place in Lagos, Nigeria.

17. Indemnification

Bidbro is indemnified from liabilities arising from changes in Nigerian laws or policies. Users are responsible for ensuring compliance with relevant laws. By using the platform, users agree to indemnify and hold Bidbro, its directors, shareholders, employees, agents, partners, subsidiaries, and affiliates harmless from any legal actions arising from the conduct of auctioneers or bidders, including but not limited to the legality or ownership of auctioned assets.

18. Privacy and Data Sharing

Bidbro will share necessary information between winning bidders and auctioneers to facilitate asset pickup. Only the required data will be shared, and solely for the purpose of completing transactions. Refer to our Privacy Policy. for detailed information on how we protect your personal data.
